Terms of Use

These terms (“Terms of Use”) govern your access and use of Nia AI Platform- Advance Machine Learning Version 3.9. (“Product”) that enables you – (“User”, “You” or “Your” as the context may require). These Terms of Use for the Product are being granted to the User solely for the purpose of the User’s participation in the Open Data Hackathon (“Event”) organized by GovHack.org from August 14 to 16, 2020 (“Purpose”).

  • Subject to the terms and conditions set forth in these Terms of Use, the EdgeVerve grants the User a non-exclusive, non-transferable, non-commercial, limited right to access this Product and the content therein for the Purpose of these Terms of Use only. The User shall access the content of this Product only for their own personal use up to a term of 3 months from the date of downloading the Product. The User agrees not to interrupt or attempt to interrupt the operation of the Product in any manner.
  • This Product, including all the content present, is the property of EdgeVerve Systems Limited (“EdgeVerve”) or the source from where the content is taken, and is copyrighted and protected by worldwide copyright laws and treaty provisions. The User hereby agrees to comply with all copyright laws worldwide in the use of this Product and to prevent any unauthorized copying of the Product and its contents. EdgeVerve does not grant any express or implied rights under any patents, trademarks, copyrights or trade secret information.
  • The User shall not falsify or delete any copyright management information, such as author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other Content contained in a file that is uploaded.
  • The User may not, copy, distribute, transmit, display, perform, reproduce, duplicate, publish, edit or create any derivate works of the content presented on the Application. Any unauthorized use of the Product or its contents shall lead to termination of the access granted by EdgeVerve.
  • The User agrees to use this Product in accordance with the applicable rules, regulations, laws and policies of EdgeVerve and the Event.
  • The User accessing the Product for contributing any content shall not reveal any personally identifiable data or sensitive personal information of his/herself or any other person.
  • The User accessing the Product for contributing any content shall not in any manner reveal confidential or proprietary information of any third party.
  • The User shall not contribute any content which infringes intellectual property rights of any third parties.
  • The User shall not transfer their rights to access to another person unless they have obtained explicit consent from the EdgeVerve in writing to do so.
  • The User shall acknowledge that the EdgeVerve may, at its sole discretion, monitor, remove or edit any content that the User may provide. EdgeVerve may also pursue remedies available to it under law for any violation of these terms and conditions.
  • EdgeVerve reserves the right to change these terms and conditions at any time at its discretion. Your continued use of the Product after the posting of any amended terms and conditions shall constitute your agreement to be bound by any such changes.
  • TO THE EXTENT ALLOWABLE BY APPLICABLE LAW, EDGEVERVE AND ITS AFFILIATES, SUBSIDIARIES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS ARE NOT LIABLE TO ANY USER FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, REVENUE, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF EDGEVERVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), HOWEVER CAUSED, WHETHER IN CONTRACT, TORT, OR OTHERWISE, ARISING OUT OF OR RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE PRODUCT, (ii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iv) STATEMENTS, MESSAGES, OR CONDUCT OF ANY THIRD PARTY; OR (v) ANY OTHER MATTER. FOR ANY DIRECT DAMAGES ARISING OUT OF THIS TERMS OF USE, EDGEVERVE’S TOTAL LIABILITY SHALL BE USD 500.
  • The Product (and third party or OSS component thereof) is provided “as is”. EdgeVerve and its suppliers and licensors hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement. Neither EdgeVerve nor its suppliers and licensors, makes any warranty that the Product will be error free or that access thereto will be continuous or uninterrupted. User understands that it download from, or otherwise obtain content or services its own discretion and risk.
